New Jersey Cannabis Businesses Types

New Jersey currently has these types of cannabis businesses allowed within the state

   

Class 1 Cannabis Cultivator : Grow recreational use cannabis

Class 2 Cannabis Manufacturer : Produce recreational use cannabis

Class 3 Cannabis Wholesaler : Store, sell or otherwise transfer, recreational use cannabis items between cannabis cultivators, wholesalers, or retailers

Class 4 Cannabis Distributor : Transport cannabis items in bulk between cannabis cultivators, manufacturers, or retailers within the state of New Jersey

Class 5 Cannabis Retailer : Purchase recreational cannabis from licensed cultivators, manufacturers, or wholesalers and sell those items to consumers in a retail store

Class 6 Cannabis Delivery : Transport a consumer’s purchases of recreational use cannabis and related supplies from the retailer to that consumer

Conditional license : Begin building out operations for the cultivation, manufacture, dispensing, wholesale, distribution, or delivery of recreational use cannabis while working towards meeting the requirements for a cannabis cultivator, manufacturer, dispensary, wholesaler, distributor, or delivery license

Prioritized Licenses

The rules establish three types of cannabis businesses that will receive priority review and approval in the application process:

Social Equity Businesses, which are owned by people who have lived in economically disadvantaged areas of the state or who have past convictions for cannabis offenses

Diversely Owned Businesses, which are minority-owned, woman-owned, or disabled veteran-owned and certified as such by the New Jersey Department of the Treasury in one or more of the listed categories

Impact Zone Businesses, which are located in an Impact Zone, owned by people from Impact Zones, or employ residents of Impact Zones. Under the statute, Impact Zones are municipalities with a large population, high unemployment rate, or high numbers of crime or arrests for marijuana.

“Cannabis cultivator” means a business or organization owned and controlled by a license-holder that holds a Class 1 Cannabis Cultivator license issued by the Commission.

“Cannabis delivery service” means a business or organization owned and controlled by a license-holder that holds a Class 6 Cannabis Delivery license issued by the Commission.

“Cannabis distributor” means a business or organization owned and controlled by a license-holder that holds a Class 4 Cannabis Distributor license issued by the Commission.

“Cannabis establishment” means a cannabis cultivator, a cannabis manufacturer, a cannabis wholesaler, or a cannabis retailer.

“Cannabis manufacturer” means a business or organization owned and controlled by a license-holder that holds a Class 2 Cannabis Manufacturer license issued from the Commission.

“Cannabis retailer” means a business or organization owned and controlled by a license holder who holds a Class 5 Cannabis Retailer license issued by the Commission.
